User Generated Content T&C's

These terms apply when you submit user-generated content (UGC), including but not limited to videos, photos, reviews, and testimonials (“Content”), to Darker Apparel Pty Ltd (“Darker Apparel”, “we”, “us”, “our”).

1. Eligibility

By submitting Content, you confirm that:

  • You are aged 18 or over.

  • You have full rights to the Content you submit.

  • No one else’s rights (including copyright, privacy, or publicity rights) are being infringed by your submission.

  • Employees of Darker Apparel and their immediate family members are not eligible for incentives associated with UGC submissions.

2. Rights and Permissions

By submitting Content, you grant Darker Apparel a worldwide, perpetual, irrevocable, royalty-free, transferable, sublicensable license to:

  • Use, reproduce, distribute, display, and create derivative works of your Content in any media (including but not limited to social media, marketing materials, advertising, and on our website).

  • Edit or modify the Content for formatting or presentation purposes, provided the substance of the Content is not materially altered.

You agree that Darker Apparel is under no obligation to use your Content.

3. Content Requirements

Content must:

  • Accurately represent your honest opinions and experiences with Darker Apparel products.

  • Not contain any offensive, defamatory, or unlawful material.

  • Not contain third-party trademarks, logos, or images without permission.

4. Liability

You are responsible for the Content you submit. Darker Apparel is not liable for any legal issues that arise from your Content.

You agree to indemnify and hold Darker Apparel harmless from any claims or damages arising from your submission or our use of your Content.

5. Privacy

By submitting Content, you consent to Darker Apparel processing any personal data included in your submission in accordance with our Privacy Policy.

6. Amendments

Darker Apparel reserves the right to amend these terms at any time. Any changes will be posted on this page.

7. Acceptance of Terms
